Personal Data Processing Policy
FOMENTO – Fundos de Investimento Imobiliário, SGOIC, S.A. (“FOMENTO”) is committed to protecting and respecting the privacy of visitors to the www.fomento-sgoic.pt portal, as well as the platforms it manages.

After the entry into force on May 25, 2018, in all Member States of the European Union, of EU Regulation 2016/679 of the European Parliament and of the Council, on April 27, 2016 (General Regulation on the Data Protection – GDPR) it is necessary to publish this Personal Data Processing Policy, which underlies FOMENTO’ commitment to respecting the rules for the protection of personal data.

This Policy thus establishes that any personal data obtained, or provided, by the respective holders is processed on this portal and/or on the platforms managed by FOMENTO. The term “personal data”, as used in this Policy, refers to information such as name, email address, address, telephone number or any other information that can be used to identify the subject. It is not necessary to provide personal information in order to browse this portal’s public areas.

Consent
By registering on the platforms managed by FOMENTO, and/or providing any personal data, the data subject is freely giving their explicit consent so that the data submitted may be processed for the purposes stated in the policy, and in compliance with the applicable laws and regulations relating to personal data.

Processing of personal data
The processing of personal data consists of an operation, or set of operations, carried out on personal data, or sets of personal data, through automated means. It consists namely in collecting, recording, organising, structuring, conserving, adapting, retrieving, consulting, using, disseminating, comparing, interconnecting, limiting, erasing or destroying data.

It is mandatory to provide some of the personal data in order to provide the service and/or information in question. FOMENTO will inform you of this obligation and, in the event of lack of, or incorrect submission of the required data, FOMENTO will not be able to provide the requested service and/or information. Submitting incorrect or inaccurate data is the sole responsibility of the respective holder.

Responsibility for treatment
This portal is the exclusive property of FOMENTO – Fundos de Investimento Imobiliário, SGOIC, S.A., legal person n.º 503511668, headquartered at Rua Ivone Silva, 6, 8º dto., the entity responsible for processing the personal data obtained or provided on the www.turismofundos.pt portal. Purpose of collecting personal data
Personal data collected on the www.fomento-sgoic.pt portal, and/or on the platforms managed by FOMENTO, are subject to treatment within the scope of the activity developed by FOMENTO, as well as the Funds managed by it.

Personal data may also be processed in order to respond to questions, suggestions or complaints presented by the respective holder.

Rights of the holders of personal data
Under the terms, and for purposes of the provisions in RGPD’s articles 13 to 22, FOMENTO informs users that any data in its possession can be consulted, treated within certain limits, rectified (due to inaccuracy or incompletion) by the respective holder and, in case the treatment was based on consent, the holder also has the right to request the data be deleted when processing does not fit into one of the lawful situations stipulated in RGPD’s article 6, paragraph 1, points b) to f).

FOMENTO further adds that, in cases where the treatment depends on consent, the data subject has the right to withdraw their consent at any time. The withdrawal of consent does not compromise the lawfulness of data treatment carried out before consent was withdrawn.

The data subject also has the right to object to further processing of his/her personal data, to be informed, upon request, of the purposes of treatment, the data categories involved, the identity of the recipients to whom data has been disclosed, as well as the storage period for that personal data. Furthermore, they must receive all personal data provided by them, and send it to another controller (“data portability”) if so desired.

Subcontractors
Under the terms provided by the legislation that regulates the processing of personal data, FOMENTO may use subcontractors for the maintenance, accommodation and management of its computer systems and equipment. These entities are obliged to maintain secrecy and guarantee security regarding the portal’s users’ data www.turismofundos.pt, and the platforms managed by Turismo Fundos, to which they also have access. Subcontractors may not use this data for any other purposes, or for their own benefit, nor may they link it to other data they have.

In any case, FOMENTO remains responsible for the personal data made available to it.

Communication and transfer of personal data
Personal data may be made available to the courts, and other competent authorities, in strict compliance with the provisions of the law. In particular when they prove necessary for resolving disputes and for activities related to the protection of public security, the defence and security of the state, and the prevention, investigation or detection of criminal offences.

Preservation of personal data
The period of time during which personal data is stored and kept, varies according to the purpose for which the information was processed.

FOMENTO retains personal data only for as long as necessary to achieve the purpose for which it was provided, or to fulfil any contractual or legal obligations to which it is bound.

Thus, and whenever there is no specific legal requirement, the data will only be kept for the minimum period necessary to comply with purposes that motivated its collection, or subsequent processing, under the terms defined by law.

Complaints
If the data subject is unable to submit a complaint directly to FOMENTO via the contacts provided for that effect, they may file a complaint directly with the National Data Protection Commission (CNPD), which is the Control Authority in Portugal.

Minors
Minors under the age of 16 must obtain authorization from their parents, or guardians, before accessing or providing personal data on the portal.

The responsibility for identifying the content and pages accessed by minors under 16 is the sole responsibility of their parents or legal guardians.

Changes to this policy
urismo Fundos reserves the right, at any time, to make adjustments or changes to its Personal Data Processing Policy, publishing such changes on its own media channels.
